Billionaire Dallas Mavericks owner Mark Cuban was investigated for allegedly sexually assaulting a woman almost seven years ago, according to a police report that was made public this week. She alleges that while they posed together, he reached down the back of her trousers and penetrated her vagina with a finger.

Cuban continues to deny the incident. Willamette Week reports that prosecutors did not press charges after finding insufficient evidence to support the woman's claims.

"The complainant requested documentation and investigation of her complaint but has confirmed with me she will not participate in a criminal prosecution and agrees her claim can not be proven". The complainant has also consistently and repeatedly stated to police investigators she does not want to pursue this matter further.

The police report details photos of Cuban and the accuser, and the detective described the photo quality as "not good enough to" see Cuban's hands.

"I really left it in the past", she told Jaquiss. The allegation comes weeks after a Sports Illustrated report detailed a series of sexual offenses within the Mavericks offices.

McGuire also noted the alleged victim's expression: "Her teeth are clenched, eyes wider than the other pictures and brow raised showing a look of surprise and strain". Brendan McGuire that Cuban was "very drunk" at the night club where the incident is alleged to have occurred. "In this case have you lied to your attorney in any way?"

Cuban denied the allegation at the time, passed a polygraph test and hired a lawyer who cited the opinion of two urologists at George Washington University Medical School who claimed he could not have sexually assaulted the woman.

In a report explaining why they weren't pursuing the case, prosecutors wrote that "there is no evidence to corroborate the complainant's statement and there is evidence contradicting the claim".
