Austria legalizes same-sex marriage

The court gave the government and parliament until January 1, 2019, to agree on legislation allowing same-sex couples to enter civil marriage.

The court ruled that the law on civil marriage, which limits civil marriage to a union between a woman and a man, violates the prohibition against discrimination in the Austrian constitution.

In 2010, Austria adopted a law on registered partnership, applicable only to same-sex couples.

Under the court's ruling, registered partnerships will still exist but will be available to both same-sex and heterosexual couples.

". The distinction between marriage and registered partnership cannot be maintained today without discriminating against same-sex couples", a translated statement from the court reads.

That left sexual orientation as the main difference between those allowed to marry and those who could enter only into a legal partnership, which the court found discriminatory.

The restrictions on same-sex marriage are now set to be lifted on the final day of 2018, unless the government decides to do it earlier, and the new law will go into effect on January 1, 2019.

Last month, Australia became the 26th nation to follow suit after the country voted overwhelming in favour of legalising same-sex marriage. However, in the state's laws on marriage it had been explicitly stated that only two people of the opposite sex could marry.

"Austria is the first European country to recognise marriage equality for same-gender couples as a fundamental human right".

Constitutional courts in South Africa, Colombia, and Taiwan have also ruled that a ban on same-sex marriage in unconstitutional.

While LGBTQI couples will have to wait for that rule expiration date to pass, the court also ruled that the individual couple that challenged the issue in court - along with four other couples who filed complaints - would be allowed to marry immediately.
