Hollywood heavyweights Harvey Weinstein and James Toback have both been accused of sexual assault
New York City Police Department Deputy Chief of Detectives Robert Boyce told a news conference that the alleged victim "put forth a credible and detailed narrative".
Detectives in NY believe they have enough evidence to arrest Harvey Weinstein, the disgraced Hollywood mogul, after an actress claimed he raped her twice in the city in 2010.
The first instance, de la Huerta said, was in November of that year.
Boyce said detectives found the "Boardwalk Empire" actress' story believable and that two people corroborated portions of her account. "As this is an active investigation, we will not be commenting further", a spokesperson for Manhattan District Attorney Cy Vance's office said.
"We have an actual case here".
In October 2010, twelve years after first meeting Weinstein on the set of the film "Cider House Rules", de la Huerta said she ran into the producer at a club in Manhattan's Tribeca neighborhood, where both she and Weinstein lived.
"He pushed me on the bed... and it happened all very suddenly", she told CBS News over the phone.

De la Huerta said that the second alleged incident occured in December 2010, saying Weinstein turned up at her apartment after she had been drinking and was not in a condition to give consent.
Weinstein is in Phoenix for treatment following his recent sex scandal, which cost him his marriage, his reputation and his seat on The Weinstein Company board.
According to the Times, "The theater had agreed to reimburse Mr. Weinstein and other investors for a $1.25 million payment and $500,000 charitable contribution toward the show if they could get third parties to donate those amounts, according to records of the arrangement".
Since then, dozens of women have come forward to tell similar tales of harassment or assault.
