The jury doesn't have to make a decision of guilt in this case, University of Denver adjunct professor Karen Steinhauser said. Her lawyers have called the photo "damning" proof that Mueller groped her. He is seeking at least $3 million in damages. Swift is seeking $1. He blames her for loss of income and damaging his reputation. The process was slow, though, and has been extended into Tuesday morning.

Although the alleged groping could have been considered a crime under local law, Swift did not report it to police.

Each side will be given 25 minutes.

Potential jurors were also asked about whether they had seen any photographs related to the case.

Here is a brief rundown of the claims and counter-claims. The "Shake It Off" singer countersued, saying in court papers that he "intentionally reached under her skirt, and groped with his hand an intimate part of her body in an inappropriate manner, against her will, and without her permission".

- Shannon Melcher, Mueller's girlfriend at the time, will testify about standing on the other side of Swift when the photo was taken, and to Mueller's character.

Swift confirmed that they did inform the manager of KYGO management about the supposed incident, but she denied that she demanded for his ousting.

Opening statements were expected to begin Tuesday in the case that could last two weeks.
