The term "executive privilege" is not in the U.S. Constitution.

White House officials had weighed trying to block Comey by arguing that his discussions with the president pertained to national security and that there was an expectation of privacy.

"In the context of a criminal investigation, executive privilege has to give way", said Saikrishna Prakash, who lectures on constitutional law and the separation of powers at the University of Virginia in Charlottesville. Bill Clinton tried, and he lost, too. Although some documents were protected in that case, most were not.

President Barack Obama invoked executive privilege in a bid to stop Congress from seeing records about Operation Fast and Furious, a botched gun-smuggling investigation that lost track of about 1,400 guns. He will appear in a public session and behind closed doors. The Fast and Furious case is a great example.

"But violating executive privilege isn't a crime". A White House official later confirmed to Bloomberg that the Trump administration was reviewing the matter. Just like the travel ban litigation, it looks like Trump's mouth has again foreclosed a legal defense he may really need.

Sewell: Shouldn't the American people be concerned what - I think that it's really hard for us to fathom that he wouldn't know that he should've disclosed that he received $30,000 as a part of - of a speaking engagement to RT, the Russian U.S. anti-propaganda outlet. Senators have already said they want to hear more from Comey about his interactions with Trump and any potential interference Trump exerted on him regarding FBI investigations into his campaign or associates.

The New York Times reported that one official said Trump actually wants Comey to testify because the president has nothing to hide. But is it true?

Legal experts have said that Mr. Trump's tweets about Mr. Comey would damage any claim of executive privilege.

"Clearly, it would be very, very troubling if the president of the United States is interfering in investigations that affect potentially the president and his closest associates", said Sen.

She also took a shot at Comey allies, who since his firing have made media appearances to reveal his discomfort and concerns about Trump while he was working for the government.

Today, a White House spokesperson referred a question about the Times' story to outside counsel.

There are already calls for Donald Trump to be impeached if was clear that he fired James Comey to stop the Russian Federation investigation.

The White House is telling federal agencies to blow off Democratic lawmakers' oversight requests, as Republicans fear the information could be weaponized against President Donald Trump.

SC senator Lindsey Graham suggested Friday that a planned hearing next week with former Federal Bureau of Investigation director James Comey could descend into a political "hit job" if the director focuses only on reported conversations between him and the president.

The White House is offering no comment on whether it will claim executive privilege ahead of Comey's scheduled testimony.

"There is no substance to this, so the only way to look at it is as an attempt to distract the headlines and the public from Comey's public testimony and Mueller's investigation, both of which are serious", said one of the USA officials familiar with the information Nunes subpoenaed.
